Title: Question on gov laws
Post by: braddo on May 10, 2006, 06:54:39 PM
Ok we all know the bs with fish and the DPI latest thing I have heard once they have finished with stuffin up the americans cichlid trade the plan on moving in on african breeders. Which basically means no more of our favourate species. Was wondering if there has been anyone going for an allowable breeders list. Eg like the allowable import list but for fish that you can't import but breed. As we know if you get a license you can only breed what is on the import list. So has anyone thought of puting forward a breeders list to go along with the license and try and open up what is available to us to breed. Just a thought and maybe a few years behind in the ideas department.

Mate recieved word from an importer yesterday they will start their raids again very soon targeting American breeders first and africans after that. The problem is we may have heard this a while back but when it happens we will all carry on and then it is too late they have done this with wild caught seahorses and it is only matter of when not if it is going too happen.

don't get your panties in a bunch brad, this is what happens when ppl don't get all the facts --- yes devils jags etc are on the copping block but have been for a number of years . at this stage it is only a [b:940edff7c0][size=18:940edff7c0]rumour [/size:940edff7c0][/b:940edff7c0] i had a frendly chat to an aqis inspector and he said yes he has heard that too but nothing official

Thanks for clearing that up. That is all I wanted to know but it is a shame we can't get some form of breeders schedule together so we can breed unimportable fish(big word eh). But hey we will see what happens I suppose.

I think people are getting a little confused about administrative departments of governments and various legislations.

AQIS is only interested in animals etc..comimg into Australia from overseas.  They are not interested in fish species aready established in Australia from way back before the regulations were chainged.

AQIS is Commonwealth Government.

The regulations covering "declared" or "Noxious" species is State departments of Agriculture and Fisheries or what ever body in which ever State.

For example, Koi carp are illegal in Qld, but are kept, sold, and commercially bred in other states. That is a State regulation.

To confuse things even more you can't import Koi anywhere in Australia either or AQIS get involved but AQIS are not interested in fish bred in Australia.

Be thankfull you don't live in a State where even the humble Convit is illegal along with just about every other South American.

Thanks Alan I wasn't talking about aqis but the dpi fisheries who control what we can and can't breed. The trouble is there is so much talk about this that it is impossible to find out what is true. Like I said I will keep an eye out on what is happenin and roll with the punches as always.

Already have a hard copy of both noxious and importable but do you relise that they only want us to breed what is importable and electric yellows and blues as well as most haps and utaka ain't there.

Where is something official saying that?   Anyway, RDs Jags & ocnvicts are a bigger threat to native fish than electric yellows & blues & even they aren't mentioned on the noxious list Alan posted.

If they are for sale in a LFS & listed on Bayfish's wholesale list then we have nothing to worry about, if & when they disappear however...

I think the list that Alan posted is the current list. The grey list isn't finalised yet (so I believe) so there isn't much that can be done until we are told what is going to happen & what is on the list after a possible refinement.
Please correct me if I'm wrong.
Cheers Brian.

so other then rumor & speculation - how do we [i:b88cd8be14]know[/i:b88cd8be14] what is on the fabled "grey list"

it keeps being mentioned but no-one posts a link to it on a QLD Govt-co site or a scan of a document with a QLD Govt-co letterhead - how do we know what's accurate & what's paranoia?

/tin foil hat = on

Ash I have actually got the paper to register for an aqiculture license and on their and other information you receive with it it states under the license you can only breed those species which appear on schedule 6 or the allowable imports list. So it is in black and white and electric blues yellows and utaka are not on that list. The only africans which are is the aulonacara, frontosa, tropheus, lamprologus species and tricotties.

At this stage the laws don't affect me but I am thinkig for the future as currently I am under 5000L of storage and 50m square area but with a bit of luck this will change within the next 18months - 2 years as my  client(so to speak for want of a better word) requires me to produce more for them.

That's exactly what I was after!   Finally I've seen the Grey List!  Scary that a bunch of my fish (RDs & Texas) are in the list.

Braddo - Figure 2 & Figure 3 (pages 22 & 23 of PDF) together don't seem to discount the hobby breeder if they have less than 10 000l of water & sell to a LFS directly - isn't that what most people do?  (plus sales on forums).    I suppose an ad on a forum makes it a taxable business according to Fig 2 though, which sucks.

What page does it say breed allowable imports only?

Hi,

There are a few oddities about the laws in QLD and how they are enforced.
I know of people that have been raided by fisheries because they were selling their excess fish to a wholesaler and shops without an aquaculture licence. They were told it didn't matter how large you are if you sell fish you are breeding to wholesalers and shops then you are considered an aquaculture business and therefore need to an aquaculture licence.

You will probably never get a licence to breed any foreign fish species that is not on the import list as they are considered "undesirable species" and fisheries departments wouldn't be encouraging large scale breeding of them. The general hope of the legislators is that the fishes not on the list would just die out and disappear from the aquarium scene. This has happened to quite a few species already.

Just be thankful for the rules we have here. I asked NT fisheries about this very thing and they said that they consider anyone selling any aquarium fish they have bred in any amount to anyone as an aquaculture business and as such needing a licence or they could be prosecuted.

It is actually in the current laws which are available from the dpi not the propsed laws. I was around in the hobby when people I knew where getting raided and it wasn't fun to see if you were going to be next. That was about 8-9 years ago I was then the president of the sunshine coast aquarium society and its reprisentative for the what was once offapa meetings.
