Hi all, I have come across a case fish shop misnaming fish - specifically selling Apistogramma sp. Steel-Blue's as Apistogramma Steindachneri and was wondering if anybody knows if the laws (opinions/debate are fine to  :D  ) on fish and other live animals lie the same as they do with "regular stock" (ie legalities of say selling/advertising something thats it not). While it may of originally been an honest mistake (wrong stock supplied) I have emailed them twice and tried to speak to staff twice, once being laughed away, still they happily have the wrong name on the tank. I will also point out that Apistogramma sp. Steel-Blue is a hybrid species, so also comes along the fact and moral argument they are selling hybrid fish without disclosing that information (while I personally have no problem with hybrid fish most of the time I do prefer to be forarmed in examples (like this fish) where females are quite rare to non-existant etc etc)

please fire away with opinions and or facts :D

PS sorry for my rant its just bugging me a bit

Yeah have seen this with some tropheus, one particular local shop was selling Tropheus Firecracker (Tropheus Moorii Brabant Rutunga Firecracker (Magara)) which wasn't anything like the real thing.  I told them they weren't the Tropheus Firecracker but 3 weeks later that had more and still selling them as Tropheus Firecracker.

Some shops are just like that and don't care as long as the make the sale, but I guess thats life. :)

I see it almost everytime I go to any LFS, but what I find more common is generalisation of species. I've actually seen tanks labeled "Peacocks Assorted" (let alone "Africans Assorted")
I remember a few years ago I used to always see "Zebras Assorted".
Next will be "Tropheus Assorted".

first of all i dont see any problem with putting "assorted africans" or " asoorted peacocks" on a tank, it takes 1 question before the sale to ask what e xact species it is. in some towns this is most often the case.

but for misnameing fish deliberatly , That is wrong.

reminds me of a certain shop (non sponsor) on the coast who was selling "cichla timensis". i knew 1 of the staff and i told him but he said the boss just laughed.
then a few months later the said manager came into my shop and noiticed i was selling "monoculas" and started talking about it, so i mentioned the wrong name in his shop and he said he had been in the industry 15 years and would know more than a newby

haha problem is the people i get my fish off are the people who kn ow there stuff so........lol

I personally dislike fish being misnamed as much as any one but one really can't say if its deliberate or not. Some are misnamed at Wholesale level just to give them a more appealing name which really stinks but in other cases it can be accidental. As for not changing the name after being told about the incorrect name it really depends if you are known to the shop management/owners ect as a knowledgable person in Apstos. (I'm not saying you're not, but if you are does the shop owner know that) or are you just an occacional customer.
I can tell you that half the people who walk into a aquarium/pet store think they are experts on everything and tell staff all day long about what they are doing wrong so these comments tend to be ignored unless its from someone that you know knows their stuff. If you are known to them then they really should have looked into it properly. I was reported to the RSPCA once for not having food and water in a cage with a stuffed kids toy bird for display...thats how stupid some people can be.
This may be a reason why you're complaint fell on deaf ears.  It may also be that the owners do indeed not care as long as they make a sale and there are some of them out there sadly too.
As for "Assorted Peacocks"....That is how they are imported and labled so that there is no obligation is specify what Species, Sub Species or colour variant they may be.  They are simply "Assorted".

I have found most LFS label there fish according to what they are told they are or according to what they orrdered from a wholesale list
I dont like stores selling assorted anything because this can cause problems with crossed fish being sold back to people because the uniformed (for lack of a better word) in the hobby dont understand how things should work. But at the same time it isnt the stores responsibilty to educted the people buying the fish either

I hate cross breeding fish and people who do it and you are correct. People do buy these "assorted" fish and cross breeding can occur but these "assorted fish" are clearly marked "FOR DISPLAY" on the wholesale list.
Its hobbbists who keep allsorts of Africans together thinking that they will only breed with their own colour and then selling off the young uncoloured fry as Electric Yellow for example that are really annoying as they should know better.

i know one shop the he used to mix all did not have a clue what he had mixed two types of jacobfrigergi once together then ask if i could sepperate! males yes but females no way. he  since has taken some advice and with some help we are tidying things up. [oh doing this for free for the african fish.  :D

While probably fairly unknown to staff at this particular store, in my first email I gave a detailed explenation of what the real version of this fish is supoosed to look like, eg different tailshape, colouration etc. the 2nd time email I just told them to "google" the different names and look for themselves   . Not sure what gets me going most really that they couldn't be wrong attitude or their non-disclosure of a hybrid fish breed (and yes I did purchase 2 before I was able correctly identify them, which left with 2 useless fish)

Fair enough then.  Would have to agree that it is poor judgement of the shop.
Put them into the 'only concerned with the money basket then'

This was the only point I was trying to make.  8)

here fishie fishie

Cichlids bought from Wholesalers?  :?
Funny, I thought most lfs brought most of their Cichlids off local breeders, as it was cheaper to buy this way than from a wholesaler.

(Oh, unless of course they have there own import facility, or a new species comes up on the list, or there is a customer demand on something that dosen't seem to bred at the time, eg;Oscars)

As for assorted peacocks, if sold as such whats the problem? people tend to use these as display fish & also wouldn't these fish be assorted as of  breeders practises local or overseas in the first place?

As for the wrong naming of fish, I hope the lfs is trying to do the right thing, if you don't think they are, vote with your wallet.
